Communication on the Displacement of Workers to Spain

Companies that relocate their workers to Spain within the framework of a transnational service provision must communicate this displacement before the start of the activity to the General Directorate of Labor of the competent Autonomous Community.

When submitting the communication, it is essential to have the service of a professional representative in the country who is in charge of this procedure and ensures contact with the control agents of the labor inspection. When processing the displacement communication, the employer must take into account that:

  1. If the company relocates its workers for the execution of work under subcontracting in the construction sector, the registration number in the Register of Accredited Companies must necessarily appear in the communication.
  2. The communication will be filled out in Spanish and all the documentation that is accompanied must be presented in its original language and translated into Spanish.
  3. If the company relocating its workers is a temporary employment company, it must accompany the communication with the following documents:
  • The accreditation that it meets the requirements demanded by the legislation of its establishment State to make available to another user company, on a temporary basis, workers contracted by it.
  • The precision of the temporary needs of the user company that are to be satisfied with the contract of provision, with an indication of the case that corresponds to those provided for in article 6 of Law 14/1994, of June 1, which regulates temporary employment companies.

Exceptions

The communication of transnational displacements that last less than eight days will not be necessary, unless the company carrying out the displacement is a temporary employment company, in which case, such communication must indeed be carried out.
